2 Questions: 

I'm on marriage visa but we're leaving Thailand for good end of december, likely 27th/28th. 

My last entry was Sept 20th. So my 90d reporting would be from 6th - 27th december. 

Is there anything happening to me if i miss the 90d reporting and want to leave the country?

I have a new Passport waiting at my embassy and if they hand me that one out, they also give me a letter to present to immigration that i do have a new passport so they can swap the visa from old PP to the new PP

Do they let me leave the country with my new passport (and my invalid old one) or do they keep me "hostage"? 

All the people now saying: Just go to immigration and do your duties: thanks for advising, doesn't answer the question.

You leave for good. That does mean you will never be back to do another 90 day report where you could be fined for missing this last one. You can take both passports and leave the country, as I assume your marriage will continue on leaving. But if I'm wrong in this and you have the big stamp Extension of Stay from an Immigration Office you have to cancel this on the day of your divorce.

If you like you can visit Immigration and get the stamp transferred to your new passport, if you also have a valid re-entry stamp and like to visit Thailand before your permitted up to date, then yes transfer them. If you not come back for a visit and let the Extension run out his time, just leave
