Iβm in Phuket on a non-O retirement visa. I understand I cannot work, but is there any way I can buy a 50% ownership in an existing business? If not, is it possible for me to switch to a type of visa that will permit me to buy part ownership in an existing business? I do not intend to work at the business, just be a passive investor, but I need to be an owner or shareholder of record.

TLDR : Answer Summary
In Thailand, on a non-O retirement visa, you can invest in a business but cannot own more than 49% unless it is a BOI (Board of Investment) registered company. While you may not need a specific visa to invest (as long as you do not work in the business), the ownership limitations apply regardless of your visa type. Additionally, U.S. citizens can own 100% of a business under the Amity Treaty, provided that the business isn't a landholding entity.

As an American under the Amity agreement you can own 100% of a company as long as it's not ownership of land but you have to make the investment as an American company so I don't know if that would be appropriate for you.
Yes you can. If it is a regular registered business the 49% rule applies, but if it is a BOI registered business you could theoretically own all of the stock.

You can invest on a retirement visa but you can't own more than 49% of the business. You can use the articles to protect your rights but you need a lawyer who understands your requirements.
Definitely will consult with a lawyer, just wanted to know whether it would effect my visa. Thank you, this gets me going in the right direction π

You do not need a work permit or any specific visa to invest in Thailand. Many people buy condos and rent them out as investment properties. The same with businesses, you can invest in (almost anything).

I think you can only own 49 % of the Buisness rest has to be Thai owned.
Makes no difference about visa if you are not working there
